Important information about how Aero Benny operates under 14 CFR Part 295.
Role of Aero Benny
Aero Benny LLC is an air charter broker as defined in 14 CFR Part 295. Aero Benny LLC is not a direct air carrier or foreign direct air carrier and does not own, operate, maintain, or control aircraft. Aero Benny LLC arranges single entity charter air transportation as a foreign indirect air carrier (international trips) or indirect air carrier (domestic trips) within the meaning of 14 CFR § 295.5(g).
Flights operated by FAA-certificated direct air carriers
All flights arranged through Aero Benny are operated by properly licensed direct air carriers — FAA-certificated Part 135 carriers on U.S.-touching segments, and licensed foreign direct air carriers on segments outside the U.S. Aircraft availability, type, specifications, routing, and pricing are subject to the operator's confirmation at the time of booking. The operator holds full operational control of the flight at all times.
Per-trip disclosures under 14 CFR § 295.24
Before each charter contract, Aero Benny provides the charterer with the following written disclosures: (1) the corporate name of the direct air carrier in operational control of the flight and any other names under which that carrier holds itself out; (2) the capacity in which Aero Benny is acting for that trip (indirect air carrier, foreign indirect air carrier, or, where expressly authorized, bona fide agent of the charterer or operator); and (3) the existence or absence of liability insurance held by Aero Benny covering the charterer, passengers, and property, and the monetary limits of any such insurance. Additional disclosures — total cost paid through Aero Benny, third-party fees the charterer pays directly, and any business relationship between Aero Benny and the operator — are provided on request and in any case before the start of air transportation.
Quotes, pricing, and confirmations
Quotes are estimates based on operator availability at the time of quotation and are not binding until confirmed in writing. Final terms are governed by the charter agreement issued by Aero Benny for the specific trip. Where information changes after a charter contract is signed, Aero Benny provides updated written disclosure to the charterer within a reasonable time, in accordance with 14 CFR § 295.24(b)–(f).
Safety vetting
Aero Benny requires that the direct air carrier operating each charter hold a current ARGUS Platinum or Wyvern Wingman safety rating, or an equivalent recognized third-party safety audit, verified at the time of booking. For each trip, Aero Benny additionally reviews per-aircraft and per-crew safety information. Aero Benny makes no representations about operators beyond the information disclosed in writing for each specific trip.
Advertising (14 CFR § 295.23)
All Aero Benny solicitation materials, advertisements, and internet web pages clearly and conspicuously state that Aero Benny is an air charter broker, that Aero Benny is not a direct air carrier or direct foreign air carrier in operational control of aircraft, and that the air service advertised will be provided by a properly licensed direct air carrier or direct foreign air carrier.
Refunds (14 CFR § 295.26)
Where charter air transportation cannot be performed or refunds are otherwise due, Aero Benny issues refunds in accordance with 14 CFR § 295.26: credit-card refunds in accordance with 14 CFR § 374.3 and 12 CFR Part 226; cash and check refunds within 20 days of a complete refund request.
Privacy
Information shared through the inquiry form is used to coordinate your request with aviation partners and Aero Benny staff. We do not sell personal information. International trip coordination may require sharing relevant passenger and itinerary information with the direct air carrier, ground service providers, and government authorities (immigration, customs, advance passenger information systems).
